Terms and Conditions
• Independent Contractor
This Contract is not to be construed as an employment contract in any way; the Photographer functions as an independent contractor.
• Reservation
Upon receipt and acceptance of a signed copy of the Wedding Photography Contract and payment of the Deposit, Alexandre Mayeur will reserve the time and date agreed upon.
• Electronic contract and Signature
The contract can be signed electronically or printed out by the client, signed and sent to French Touch Photography.
In the case of an electronic contract, the client can request a paper copy.
The contract is considered electronically signed only after full completion by the client and payment of the deposit.
The client can withdraw their consent to conduct the transaction electronically at any time if they wish to do so.
• Non-refundable Retainer (with liquidated damages)
The clients shall pay a $1000 deposit fee to retain the Photographer to perform the services specified herein. The Deposit is credited to the total amount of the Wedding Photography Package and is non-refundable (except in any situation where the Photographer cancels this Contract or is unable to perform — see ‘Cancelation by Photographer’ and ‘Failure to Perform / Limit of Liability’, below—).
• Payment Method
Is accepted: Cash or Check named Alexandre Mayeur at no fee. Electronic payment via Venmo (@Alexandre-Mayeur) or Paypal (alex@french-touch-photography.com) adds a 3% fee.
• Payment Schedule
The remaining balance of the Wedding Photography Package is due in full one month prior to the Wedding day. In the event that the balance is not paid by this time, the Photographer can consider this Contract null and void and will not be obligated to provide photographs of the said event. There will be no refunds of any money paid once the Contract becomes null and void.No part of any order, including previews, will be delivered until the balance is paid in full.
• Late fees for Late or Missed Payments
Failure to complete payment upon the due date will result in a 5% surcharge per week that payment is late.
Returned checks will be assessed a $40 non-sufficient funds fee.
• Completion Schedule
10 days after the wedding, the photographer will post the first 10 images, chosen and retouched by the photographer discretion.
Completion of the final product: The entire editing process, from wedding to the final product reception takes up to 9 weeks for the client to receive the final product of the Event through the web gallery.
• Pre-wedding Consultation Preference
Modification of Wedding Arrangements: The details of the wedding arrangements are to be agreed beforehand in writing (email is acceptable). The clients shall notify the Photographer of any change to these details in writing. The Photographer cannot be held liable for delays or disruption in the delivery of the service until any change is received and acknowledged in writing.
• Modification of the event schedule
The clients agree to confirm the schedule at least one week prior to the wedding. Notification of any change in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from the photographer by the client.
• Modification of the contract
The clients may upgrade clients’ package selection at any time until the day of the event. The upgrade is effective after the confirmation from the photographer. However, under no circumstance shall clients be permitted to change their selection to a lower-priced package.
• Shooting Time / Additions
The clients and French Touch Photography agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting begins at the scheduled start time and ends at the scheduled end time. If the clients do not arrive at the appointed time for the event, shooting will begin at the scheduled start time and end at the scheduled end time . All additional time beyond the scheduled end time will be billed to the clients.
• Reschedule the Wedding Date due to Unforeseen circumstances
Unforeseen circumstances completely outside the clients’ control, such as natural disasters, health issues, family emergency, pandemic, job relocations, allows clients to Reschedule their wedding. date once, under the following conditions:
– To guarantee the coverage by Alexandre Mayeur, the new date must be a weekday (Monday to Friday), or a Sunday.- Rescheduling of the event in a different venue will need to be approved by the French Touch Photography.
– If the new date is a Saturday and if Alexandre Mayeur cannot perform the coverage, the clients will have their coverage assured by a third party photographer chosen by French-Touch-Photography.
– If the new time or date conflicts with French Touch Photography existing schedule, French Touch Photography reserves the right to terminate the Agreement. In the event of such termination, Clients shall forfeit any previous non-refundable deposits.
– Rescheduling during the same year is free. If the new date is in a different year, then the new year’s pricing would apply.
– Promotional, or a special offer are limited in time and conditions and are not eligible for future bookings. In such a scenario, the clients would need to agree with the regular price available for the new date.
• Cancellation of the Wedding Date
– Cancellation by the clients: The clients may cancel this contract up to 6 months prior to the wedding date by giving written notice to The Photographer but in doing so shall forfeit any money paid.
– Cancellation less than 6 months prior to the event date, will result in the payment of a $1000 fee in addition to the deposit. All cancellations must be in writing.
– Cancellation by the Photographer: The Photographer may cancel this Contract prior to the Wedding Day by written notice to the clients, and will refund, in full, any money that the clients have paid to the Photographer.
• Engagement Session and Cancelation in case of no satisfaction
The photographer will deliver the engagement pictures maximum 9 weeks after the photo session.
Special cancellation case : If the clients are unsatisfied with the images, they can decide not to continue with the photographer. And cancel the contract Then the photographer will refund the clients with their full deposit and the contract will be considered as void under these conditions.
– Clients have 24 hours after the reveal of the pictures on the web gallery to make their decision.
– The decision must be written.
– Clients restrain themselves from downloading any High Definition image of the engagement session.
– This cancellation, as specified above, is possible only 1 year prior to the event.
• Inclement Weather Policy
In the case of light rain, the photographer will continue outdoor coverage as planned while the Clients bring an umbrella to stay dry. Should weather conditions like heavy rain, snow, high winds or hazardous air quality render outdoor photography unsafe or impossible, the following options apply:
1) If the contracted package includes a post-wedding session guarantee in case of bad weather, the clients may reschedule the outdoor portion of coverage for a future date at no additional charge, subject to the photographer’s availability.
2) For contracts without the weather guarantee, the clients will proceed with indoor photography only (if possible) without refunding payments or additional costs.
• Substitute/Backup photographer attendance
In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances, French Touch Photography reserves the right to appoint another photographer to attend your wedding on our behalf to undertake the wedding photography to his/her/their best ability.
• Incorporation of Standard Price List
Services or merchandise not included in this initial contract will be sold at the current price when the order is placed. All prices are subject to change at any time without notice. Credit vouchers have no intrinsic cash value, are nominative, cannot be traded, and may only be applied toward merchandise purchased from French Touch Photography.
• Photographic materials included/defined
The clients will receive high definition, digital photos to download: all images will be on a Web Gallery, and will be downloaded by the clients.. The images will be retouched and delivered in .jpg format.
• Web Gallery
Access to the gallery is protected by a password. Clients agree to share the gallery with their guests.After the first release of their gallery, clients have 7 days to hide images. For this purpose, clients will be granted an admin password. Additional passwords can be added to some photo albums.
7 days after the release of the full gallery this last will be shared with all the guests who have used the photo-booth and have left their email address. Clients are welcome to share extend email list if they want to share the gallery to more people
The gallery is on-line for 3 months after its release. All download and selection of images (if any album) must be completed within this period. This period can be extended at extra costs.
On the event day, visit cards will be placed on the guests tables, giving them information to access the gallery.
• Retouching
Color correction: All images will be adjusted to optimize lighting, shadows, colors and image quality. This includes adjusting exposure to make bright and dark areas clearly visible, brightness to improve the overall look, contrast to emphasize differences between and dark, sharpness to clarify details, and noise/graininess which may appear in low-light photos.
That implies modification of exposure, brightness, contrast, sharpness, noise, white balance, bright and dark tones, cropping, lens correction.
The colors are adjusted so they look natural. No effect (such as Lightroom filters) will be applied to images.
The Photographer’s judgment regarding these corrections shall be deemed correct, and the result consistent with the Photographer’s work shown on French-Touch-Photography website.
The Client will be provided with the 10 first images, 10 days after the event. If the clients want any change on the edits (darker, brighter), the clients should provide a written feedback to the photographer within 3 days.
After receiving all the final high-res images, Clients have 7 days to request re-edits or dispute unsatisfactory work. After 7 days without notification from the clients, clients will be considered as having accepted the final result and can not request further edits
Digital manipulation of the content of the images are not included. That implies that beauty retouching, (cleaning the skins, brightening/opening eyes, brightening teeth, making people look taller, stronger, slimmers, younger), switching faces on pictures, and changing background are not included.
If Clients desire such artistic finishing, clients will select the photos they want to be adjusted on the web-gallery, explain their request to the Photographer and the Photographer will give Clients a price estimation regarding how many hours of work is needed.
• Inherent Qualities in the photographs
The clients understand that photography is subjective and certain qualities like lighting conditions, expression and pose are outside the photographer’s control. All photos can’t be expected to look like professionally staged portraits in magazines. Factors like blinks, movements and background noises are normal parts of candid wedding photography.
Not every photograph can reasonably be expected to be of perfect technical quality or meet the clients’ aesthetic preferences.
However, the standard of work will be consistent with the photographer’s experience and reputation in the industry. The clients agree not to reject the entire final collection of photographs or demand re-shoots solely due to individual images that may have minor, non-technical flaws when viewed as part of a full wedding coverage.
If the clients believe there are widespread, material defects in focus, exposure or other technical aspects across multiple final images despite the photographer’s best efforts, they may request additional editing be done to attempt to remedy such issues, subject to the photographer’s reasonable evaluation of whether re-edits are warranted and feasible.”
• Indemnification
The clients will be notified by e-mail of the availability of the final result on the web gallery. The clients have 7 days after the release of the web-gallery to check the result using the web-gallery.
After 7 days without notification from the clients, clients will be considered as having accepted the final result.
Clients can download up to 20 images in High Definition to check at the quality of the images for any defects.
By Downloading more than 20 images in High Definition, (or all the images in High Definition), clients forfeit the option to claim any indemnification.
If the Clients are unhappy with the edit of the images, they have 7 days to ask for re-edits, in accordance with the retouching service offered (color adjustment, cropping).
If the clients are highly not satisfied with the result, the clients can ask for a refund of any money paid. (minus the price of the services already delivered : such as : engagement session, guest book, photo-booth or other printed material).
In this case, the gallery will be turned off, the clients will not be allowed to download any pictures in High Definition and automatic waiver of rights are removed.
• Neutral third party consultant in the case of a photo satisfaction dispute
In case of a photo satisfaction dispute, to avoid a court dispute, the Clients and the photographer can agree to ask a neutral third party consultant. This consultant must be a professional wedding photographer who is a member in good standing of a recognized photographers association or guild. This consultant must be in activity, in the State where the event took place, offering the same style of photographer and be in the same price range as French-Touch-Photography and have at least 10 years of experience running their own business.
The consultant should have no link to the case at all.
Disputes do not allow clients to reject the entire collection or demand reshooting unless truly widespread defects exist across most images.
• Failure to Perform
Failure to Perform / Limit of Liability: In the unlikely event that the Photographer is unable to carry out this Contract due to a fire or other casualty, strike, act of God, illness, or any other cause whatsoever, then the Photographer shall return to the clients in full , all money that the clients have paid, including the deposit minus the price of the already offer services (engagement session, guest book album, photo-booth), but shall have no further liability with respect to this Contract. The liability of the Photographer in any event shall be limited to the refund of any money paid by the clients. This limitation on liability shall also apply in the event that photographic materials, including but not limited digital files, are damaged or lost in processing, damaged or lost through camera or computer malfunction, damaged or lost.
Clients agree that an entire Wedding cannot be replicated, re-enacted or repeated for the purpose of a reshoot, and limits the Photographer’s liability to the amount paid under this Contract. Neither party shall be liable for indirect or consequential loss.
• Photo-booth, Prints and Access to Digital images
The photo-booth starts at client’s discretion (usually after the ceremony), and ends at the end of the photography coverage.
If clients desire to extend the photo-booth, extra hours of photography coverage will be charged.
Installation: If the photographer starts the coverage at the venue, the photographer will install the photo-booth before starting the coverage if the venue rules allows it. If the venue does not allow it, if the venue is closed, or if the coverage starts at another location, then the photo-booth will be installed at the venue, by the photographer (or assistant photographer if any), during the coverage time.
The photo-booth it’s an automatic device which sometimes requires maintenance (changing batteries, adding paper roll).Therefore photographer (or assistant) will take care of the printer as soon as he is aware of the issue, and depending on his availability. As a result, the printer might not print photos for a short period of time.In such a scenario, the Clients cannot ask for any compensation.
Unlimited print includes 1 print per session.
If the venue policy does not allow photo-booth, Clients will be offered 50 prints 4×6 inch to select after the wedding.
Clients will have a digital copy of the images taken by the photo-booth., Delivered through the web-gallery.
• Copyright and Reproductions
Copyright: The Photographer shall own the copyright to all created images. The copyright act assigns the copyright of the images to the photographer. Any image or copy of images stored either digitally or otherwise and any computer program including any source or object code, computer files or printed documentation related to such images are protected by the Federal Copyright Act of 1976. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Photographer in writing.
• Usage of Images by the Clients
French Touch Photography will supply the clients with digital copy via download of high-definition images for personal use only. The clients must not claim copyright or authorship of the images, sell them or enter them into a competition where a prize is being offered.
The clients may have prints made of the images, and may reproduce and distribute any images in any manner they like for sharing with friends and relatives, in a private setting. All images have a print release for personal use.
The clients may share photos from the gallery on social media like Facebook and Instagram. When doing so, photos must not be edited or altered in any way except cropping. The photographer’s credit/tag must be included and visible in the post with a link to : French-Touch-Photography.com. Commercial or promotional use of photos on social platforms requires additional written permission.
• Photography Usage From Photographer
Usage of images by the photographer and model release: It is agreed that the photographer may display and use photographs from the Wedding Day for advertising, display, website and internet promotion, photographic contests, bridal shows, public displays, photography books, photography instructional books, store fronts, window displays, studio displays, television advertising, magazine advertising or any other purpose thought proper by the Photographer.
Furthermore, the clients hereby grant to French Touch Photography and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the clients or in which the clients may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The clients hereby release French Touch Photography and its legal representatives and assigns from all claims and liability relating to said photographs.
This release is valuable for the USA and EUROPE, for 30 years.
• Artist Right and Discretion for Images
Photographs taken during the course of the event will be at the discretion of the Photographer, although every effort will be made to comply with the clients’ requirements.
The Photographer shall be granted artistic license in relation to the poses photographed and the locations used. Although every effort will be made to comply with the clients’ requirements, the Photographer’s judgment regarding the location, poses, framing and number of photographs taken shall be deemed correct.
During the course of the event, the Photographer shall endeavor to photograph all individuals and events as requested by the clients, but no responsibility will be taken by the Photographer if certain people or events are not included. The photographer doesn’t take lists. Nevertheless the Photographer recommends to the Clients to make a list of the desired group pictures, and have someone in charge of the list : gathering people, and checking the list.
The Photographer shall make all decisions concerning which images shall be kept and which shall be discarded, which shall be computer-edited, and which shall be supplied to the clients. The clients will not have access to images that the Photographer has decided not to supply to the clients, either due to the images being considered to be of poor quality, being duplicate, or for any other reason.
The Photographer shall be granted artistic license to carry out computer editing of the photographs in any way that the Photographer sees fit. The clients will not make decisions about which photographs are edited, in what manner or by what means.
• Exclusive Photographer Clause
The Photographer shall be the exclusive photographer retained by the clients for the purpose of carrying out the photography.
• Cooperation of Clients and Guests
Family and friends of the clients shall be permitted to carry out photography just as long as they do not interfere with the Photographer’s duties. The Photographer has the right to ask others to stop photographing or, for example, to step to one side (which will be done very politely if need be).
• Personal Accident
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said people’s own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
• Compliance with Laws & Safe Working Environment
The photographer shall conduct all services and activities in full accordance with all applicable international, federal, state and local laws.
The photographer reserves the right to decline requests by the clients that violate rules or endanger health and safety.
The photographer reserves the right to terminate coverage and leave the location of the EVENT(S) if he experiences inappropriate, threatening, hostile or offensive behavior from person(s) at the EVENT(S); or in the event that the safety of the photographer is in question.
• Venue Guidelines, Officiant and Responsibility of Clients
Where photography takes place on private property or at designated venues, the photographer agrees to obey any internal guidelines, policies or contractual rules established by the location owner or manager that have legal authority.
For a booking involving a church ceremony or at certain venues, the photographer’s movements are sometimes restricted by the official in charge or by the rules and guidelines of the location(s) and site management. The area from which the photographer is able to cover the ceremony may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case. The clients agree to accept the technical results of their imposition on the photographer.
Negotiation with the officials for moderation of guidelines is the clients responsibility; the photographer will offer technical recommendations only.
• Photographer Guidance and Timeline
The Photographer agrees to provide best efforts guidance and recommendations to the clients regarding an estimated wedding day timeline and shooting schedule. This is to help facilitate coverage of important events and moments. However, the Photographer cannot guarantee adherence to any set timeline due circumstances outside their control such as delays, weather events, issues with vendors/vendue, or changes in the clients’ plans.
While the Photographer will work diligently to follow the estimated timeline where possible, shifts or limitations may be required at their reasonable discretion. The clients understand that unforeseen factors can alter any planned schedule and agree to cooperate and be flexible to maximize photo opportunities that arise.
So long as the Photographer makes professional efforts to follow client guidance and capture all key aspects of the wedding within the contracted time, they will not be held responsible for any timeline changes, absences from certain events, or failures to strictly adhere to estimated timing due to matters beyond their control. The clients accept this limitation of liability as inherent to the nature of wedding photography.
• Coordination with Videographer
If the clients choose to separately hire a wedding videographer in addition to the Photographer, they must notify the Photographer of this at the time of booking. The clients agree to facilitate proper introduction and coordination between the Photographer and videographer well in advance of the wedding date.
The clients understand that videography needs adequate time and space to properly film certain events compared to still photography. They therefore agree to reasonably adjust any estimated photography timelines, as necessary, to accommodate simultaneous coverage by both vendors without disruptions. This may require shorter individual time blocks for photography at certain locations than initially planned.
The clients are responsible for clearly communicating their video needs to both vendors and resolving any scheduling conflicts or spacing issues that arise. If proper coordination is not facilitated through no fault of the Photographer, they cannot be held responsible for any inability to cover certain moments due to simultaneous filming occurring. The clients accept this limitation as part of booking multiple visual vendors to document their wedding day.
Cooperation between all parties is required to successfully capture both photos and video with the time available on the wedding date. The clients agree to take the lead in ensuring their vendors work seamlessly together.
• Coordination with Wedding Planner
If the clients choose to separately hire a wedding planner, they must notify the Photographer of this at the time of booking. For any parts of the wedding photography planning or day-of coordination, the clients agree to designate the Photographer as the primary lead vendor regarding timeline, location selections, and posing guidance.
The clients understand the Photographer has expertise in effectively capturing memories through photos. Therefore, while wedding planners provide valuable general logistics support, the clients agree to primarily follow the Photographer’s recommendations on all matters specifically concerning photographic coverage, such as shot lists, lighting decisions, group positioning etc.
If a third party planner offers input on these photographic elements that differs from the Photographer without discussing it with them first, the planner has overstepped their defined role. In such instances, the clients commit to siding with the Photographer’s counsel on all issues directly impacting picture taking.
Ultimately, the clients are responsible for clear communication between all relevant vendors to ensure the Photographer’s vision and direction are properly facilitated on the wedding day. They agree the Photographer’s guidance on photo matters will take precedence in any planning discrepancies that arise.
This allows each vendor to focus on their individual expertise area while providing accountability that the photography aspect receives appropriate priority and support.
If the clients override the Photographer’s advice and quality of pictures is materially affected, the Photographer’s liability is limited per the terms of the contract.
• Coordination with Other Vendors
The photographer commits to reasonably coordinating photography schedules and needs with other contracted wedding vendors to maximize coverage of events.
However, the photographer cannot guarantee capturing each moment if not properly notified by clients or vendors of any changes to agreed plans or overlapping vendor priorities on site.
Nor will the photographer be liable for missing photos if reasonable coordination attempts are undermined by vendors failing to cooperate with photographic requirements or overstepping photographer’s guidance without discussion.
The onus is on clients to properly facilitate smooth collaboration between all parties and resolve any disputes that arise. The photographer’s role is advisory support to help optimize photography logistics.
• Makeup/Attire Guidance
The photographer agrees to provide best efforts recommendations to clients regarding hair, makeup and wardrobe styling suited for photographs. However, all final choices remain at clients’ discretion.
The photographer shall not be held responsible for any images that do not meet client expectations if guidance about photo-friendly styling is not followed. Clients accept the photographer’s expertise in this area and any liability associated with disregarding advice.
• Meals and Break Provided for Photography Team
The photographer(s), and the second photographer, will be allowed one 20-minute break at their own discretion, and bathroom breaks when necessary. Each photographer will be provided a full guest meal for weddings lasting longer than 6 hours. If no meal is provided, the photographer(s) reserves the right to go off-site for a meal for 45 minutes.
• Travel and Overage Fees
The Client agrees to pay a non-refundable travel fee in addition to the agreed-upon package price for any wedding taking place outside 90 miles radius radius from the Photographer's studio address. All miles in excess are charged at $0.5 per mile (outward + return).
Contracts that require multiple trips may require a travel fee for each session.
The clients are responsible for providing parking for the contracted photographers and will be charged with any additional parking charges if arrangements are not made in advance.
Contracts taking place at more than 2 hours driving from Rochester, might require an hotel room. charged to the Clients.
Coverage starting at or before 8am, or coverage finishing at, or after midnight, and located more than one hour driving from Rochester, MN, require a hotel room charged to the Clients.
The exact amount of the travel fee will be determined based on the distance and complexity of travel arrangements required. The Client will be notified of the travel fee in advance, and it will be due along with the final payment. Failure to pay the travel fee will result in the Photographer's inability to provide services for the wedding. The Client acknowledges that the travel fee is separate from any other fees or expenses outlined in this contract.
• Destination Wedding Policy
For weddings taking place over 4 hours driving distance from Rochester, MN, the following additional terms will apply.The clients shall be responsible for reimbursement of reasonable travel costs including:
– Roundtrip commercial flights for the photographer(s) based on regular economy rates.
– Three checked baggage fees per flight (without photo booth). Fives checked baggage with the photo-booth.
– Ground transportation to/from airports and between wedding locations.
– Per Diem :The clients shall provide payment of $75 per person/per day to cover standard meals and incidentals. This rate is subject to adjustment for international destinations.
– Visas/Permits: Any administration or government fees required to obtain legal visitation/work permits including photo visas shall be paid by the clients.
– Rental cost of a vehicle on location for scouting purpose.
– Itineraries:All travel itineraries including flight and accommodation details must be finalized no less than 90 days prior to the wedding to allow for booking. Changes within 90 days are subject to third party fees assessed to the clients.
• Backup Equipment Policy
The photographer agrees to arrive at all photo shoots with properly functioning professional-grade camera bodies, lenses, lighting equipment, and accessories required to complete the contracted services.
Additionally, the photographer maintains backup camera bodies, lenses, batteries, memory cards, and other key gear that can be used in the event of technical malfunctions or damage to primary equipment from reasonable and unintentional causes during a job.
If primary gear fails due to manufacturer defect or general equipment weaknesses outside the photographer’s control, they will make commercially reasonable attempts to utilize backup equipment and complete the agreed upon work in a timely fashion.
Under no circumstances is the photographer responsible for reimbursing clients or providing additional compensation for delays, reschedules or incomplete orders directly caused by acts of God or other forces beyond human control that damage photography equipment despite existing backups.
Clients acknowledge that maintaining a range of professional cameras, lighting and support devices involves large monetary investment by the photographer. This policy is in place to help protect that investment and demonstrate the photographer’s commitment to client service through redundant systems.
• Digital image Backup Policy
The photographer shall maintain a full backup of all selected raw and edited image files from the wedding on their professional-grade computer systems for a period of one year following delivery of the final image gallery to the clients, while the unselected images will be deleted one month after the full release of the web-gallery.
During this one year period, if any files become damaged, corrupted or are inadvertently missing from the initial delivery to clients, the photographer agrees to replace those files from their backup copies at no additional cost.
After the one year period, the photographer may continue to store courtesy backup copies of wedding images on their systems, but bears no legal obligation to indefinitely maintain or restore those files. If backups are deleted due to system failures, upgrades or other causes beyond the photographer’s control after the one year period, they shall not be liable for replacing or redelivering those images to clients.
Clients understand the photographer does not guarantee data security or preservation of digital files beyond the professional standard one year archive, and backup storage of images thereafter does not transfer ongoing responsibility or obligations to the photographer under this agreement.
• Client’s Wedding Album
If the contract includes any album, Clients will select the type of cover, the material, and the photographs to include in the album during the period while the gallery is activated (3 months starting from the release).
The selection will be completed through the web gallery: no list, no Excel file.
Clients can ask for specific retouches when submitting their selection (at extra cost).Clients are responsible for checking each image for imperfection (blurry area, moiré) before submitting their selection.
Once the photographer has completed the album’s layout, the clients will receive a low definition proof to validate. At this time clients are allowed to ask for modifications for each layout at no extra cost.
Then the photographer will send a second version of the album to clients for validation. If clients want extra modifications, they would be charged at extra cost.
By validating the album, clients agree on the content of the album. No reprint of the album will be allowed if clients are unhappy with any imperfection regarding the pictures, or layouts.
Printing and delivery of the album can take up to 3 months. Once the clients receive their album, they have 24h to check the album and make sure this last has not been damaged during transportation, or does not include any printing issue from the laboratory. If clients notice any damage or printing imperfection, they will immediately take pictures and send them to the photographer.
• Guestbook Album
The guestbook album requires the engagement session picture to be taken at least 2 months prior to the wedding.The clients will select 30 images from the engagement session. The photographer will design the guest book and send the proof to the clients for validations. On time modifications are included for free. Extra modification will be charged.
The guestbook album will be delivered on the wedding day.
